The Advocates and Solicitors Disciplinary Board struck Rohaizat Othman off the Roll of Advocates and Solicitors on 7 March 2008 after he was found guilty of misconduct. The Disciplinary Board's decision arose from an investigation into the complaint lodged against Rohaizat Othman by the purchaser of a piece of real property. According to the complaint, Rohaizat Othman failed to refund almost RM 161,000 to the complainant after the transaction was aborted.

Rohaizat Othman appealed against the decision of the Disciplinary Board to the High Court, and the appeal was dismissed on 12 August 2009. He is therefore legally disqualified from practising as an advocate and solicitor.

The finding of misconduct is personal to Rohaizat Othman, as the Disciplinary Board would not hold a lawyer liable for the actions of his/her law partner(s).

Straits Times of Singapore has the story of BN candidate for Permatang Pasir being disbarred by the Bar Council last year. Such a story, of course, is hot hot hot.

Shamsul Yunus the My Anger blogger has put up a quick posting here to point out that the complaints against Rohaizat Othman, he 38-year old BN man, were WITHDRAWN in March 2008. Shamsul also slams lawyer Haris Ibrahim for what he alleges to be the lawyer's "half-truth" campaign lawyer Rohaizat.

Shamsul, who will be contributing articles daily from Permatang Pasir for The Malay Mail, was trained to be a lawyer, by the way.

    Bro, this is quite different from what SY says that it was Rohaizat's partner who was responsible for CBT. The matter also went to the High Court which dismissed Rohaizat's appeal against disbarrment on 7th March 2008.

    In any event, did DPM and Zahid read the dossier fully or just skim over it before nominating Rohaizat for P.Pasir?

    Surely UMNO is not so bereft of candidates of integrity and stature that it has to plunk for a controversial choice, giving PAS and Pakatan a field day to take potshots at him, the DPM, Zahid and UMNO/BN all together? In the P.Pauh by-election in 2008, the UMNO candidate falsely claimed he has a PhD. Lol.

    KUALA LUMPUR, Aug 18 — The Bar Council has confirmed that Barisan Nasional’s (BN) candidate for the Permatang Pasir by-election, Rohaizat Othman, was found guilty of misconduct last year and struck off the rolls.

    In a statement today, Bar Council secretary George Varughese said the Advocates and Solicitors Displinary Board disbarred Rohaizat on March 7, 2008.

    The Disciplinary Board’s decision arose from an investigation into the complaint lodged against Rohaizat Othman by the purchaser of a piece of real property.

    According to the complaint, Rohaizat Othman failed to refund almost RM 161,000 to the complainant after the transaction was aborted, said Varughese.

    He said Rohaizat had also appealed to the High Court against the decision of the disciplinary board. The appeal was dismissed by the High Court last Wednesday.

    Varughese added that the finding of misconduct was personal to Rohaizat as the disciplinary board would not hold a lawyer liable for the actions of his partners.

    The Bar Council’s statement suggests that BN leaders may have been misinformed about his status.

    Penang Umno chief Datuk Zahid Hamidi had claimed yesterday that it was Rohaizat’s partner who had taken off with the client’s money.

    Deputy Umno president Tan Sri Muhyiddin Yassin also accused the opposition of character assassination and claimed Rohaizat was not legally wrong.

    But the Bar Council has now made it clear that Rohaizat was personally found guilty of misconduct." MI 18/08/09

  9. funny thing bout what’s is going on with this BN candidate.the umno fellas rocky bru and shamsul yunus tryin to paint as if the umno calun fella has been a victim of injustice of the very own system he practise.kununnya the case has been withdrawn and in appeal stage since last year.i am not a law graduate, and hence can only comment from my own point of view.It is strange how well educated guys ( i assume) like rocky bru and shamsul would succumb so low to protect the man who could as well be the scum of the earth.I say this coz first the guy already been disbarred, and secondly for god sake, takin money from pekebun getah yg kais pagi makan pagi…come onla rocky …wise up…i salute haris for this exposure…

    perhaps you can clarify on the excerpt below:

    The Sun today reported:

    When contacted, Bar Council chairman Ragunath Kesavan said all offences under the Legal Profession Act, under which Rohaizat was guilty, hold personal liability.

    Stressing that the charge as tantamount to criminal misconduct, he said Rohaizat, not his partner, was named by the complainant over a sum of about RM140,000.

    “If you are an innocent party, you would not be found guilty by the (Bar Council’s) disciplinary board. Rohaizat’s appeal against the Bar Council decision was dismissed by the High Court on Aug 12,” said Ragunath.

    If the appeal has already been dismissed, he stands guilty, no?

    What's the problem? Your friend Anwar Ibrahim was convicted of - 1/ Sodomy and 2/ Abuse of Power 10 years ago. He was released by the Sleepy Prime Minister but cannot stand for election last year in March becos the ban on him contesting ran till April. (Anwar did not run in the March elections because his abuse of power conviction barred him from holding political office for five years. The ban ended in April).

    So there you are! What's the problem? Sodomiser and Power Abuser can still stand for election and almost became our Prime Minister last September, right?

    Obviously someone screwed up in the whole vetting process.......
    But this is a problem when warlords rule which candidate gets picked - their criteria is who is able to pay the most. He's also a top gun in UMNO Youth so no one was going to worry too much on the vetting side.

    However I will give UMNO some lee way on this as this a problem that Pakatan needs to sort out as well.
    There are too many candidates, ADUNs, MPs and so on who have not been carefully vetted and are real sub-quality.
    Perak was bought down by 3 real sub-quality PR candidates who had no conviction to the cause.

    Thus lesson to be learnt by all parties: "Pick candidates with integrity and commitment to public service" or you will end up in a mess.

  27. Bro, on the other hand SPR has accepted Rohaizat's nomination so he is a legitimate candidate.

    The issue is not such a big deal, if People like Haris Ibrahim and his Pakatan Rakus Cohort wants to make an issue,then they need not go too far to know their own leaders:

    -Anwar Ibrahim who is an ex-convict, sentenced for abuse of power also got re-elected as Permatang Pauh MP.

    -Lim Guan Eng is also an ex-convict, sentenced for sedition, he won in Penang and was duly appointed as Menteri Besar.

    So UMNO just have to work extra hard to defend their man at Permatang Pasir.

    Tindakan puak DAP sejak kebelakangan ini amat kurang menyenang kan hati kita semua.

    Tindakan puak DAP , sekutu dan kuncu-kuncunya yang menghasut, menyemarak kan kebencian mereka terhadap agama, bangsa , raja melayu serta kaum bumiputra, tidak lain dengan tujuan untuk memenangi minda, pengaruh dan juga demi survival bangsa mereka.

    Ya, tujuan sebenar mereka hanya lah ingin menjaga dan melindungi kepentingan ekonomi mereka dan bagi mereka, golongan bumiputra di Negara ini hanya layak menjadi coolie, pekerja makan gaji dan hanya boleh menerima arahan.

    Seperti yang kita ketahui, Negara republik Singapura telah pun mempersiapkan bala tentera mereka pada tahap yang amat tinggi.

    Kecanggihan dan Peralatan ketenteraan yang mereka miliki mampu menghadapi tiga medan pertempuran yang berbeza pada masa yang sama.

    Sesuatu peperangan (tanpa menggunakan senjata nuclear) yang tercetus hanya memerlukan satu isu yang kecil dan juga salah faham.

    Dan apabila tentera republik Singapura datang menyerang, mereka tidak akan menakluk seluruh tanah melayu ini tetapi tujuan sebenar mereka hanya ingin mengambil negeri Johor sebagai zon penampan dan menjadikan sebahagian wilayah jajahan mereka.

    Saudara-saudari ku, Allah kurniakan akal yang sihat dan sudah tentulah kita tidak akan membenarkan sebarang penyalahgunaan kuasa di dalam pembelian alat kelengkapan ketenteraan Negara kita.

    Tetapi pihak pembangkang sehingga hari ini, masih lagi tidak mempunyai bukti yang kukuh berhubung isu pembelian alat kelengkapan tentera kita?

    Maka persoalan lain pula yang timbul, mengapa pula pihak pembangkang begitu berapi-api menimbulkan isu ini, adakah mereka ingin melihat Negara kita berada didalam keadaan lemah dan membiarkan sahaja tentera republik singapura datang menyerang Negara ini tanpa tentangan yang sengit?

    Dan mengapa pula pembangkang dan rakyat singapura sendiri tidak mempersoalkan pembelian alat ketenteraan mereka yang 2 hingga 3kali ganda jauh lebih tinggi dari perbelanjaan pertahanan Negara ini?

    Jika sekadar mempertahan kan diri mengapa perlu berbelanja begitu tinggi?

    Adakah kita sudah lupa apabila tentera Jepun menjajah Negara ini, mereka terlebih dahulu telah menempatkan pengintip mereka untuk memberi maklumat dan mengkaji kelemahan pertahanan Negara ini?

    Dan sekarang , jika tentera Singapura datang menyerang dan menjajah, golongan mana dan siapakah pula yang akan menjadi pengkhianat , talibarut dan membantu memberi maklumat Negara `red dot’ ini?

    Golongan pengkhianat mana pula yang bersedia untuk menjual Negara ini kepada pembida yang tertinggi?

    Golongan pengkhianat mana pula yang terlebih dahulu akan melarikan diri dari Negara ini ?

    Dan jika perang meletus, bermakna kita terpaksa berhadapan musuh di dua medan iaitu pengkhianat di dalam Negara dan juga bala tentera republik singapura yang menyerang , pada masa yang sama.

    Semua nya telah terbentang luas dan ianya berada di depan kita semua.

    sudah terang lagi nak bersuluh?

    Jihad tidak mengenal tempat, sama ada di depan keyboard computer, kerja seharian ataupun sebagai anggota keselamatan, kerana niat dan tujuan kita tetap sama iaitu mempertahan kan agama, bangsa dan negara.

    I suppose Shamsul should realised that if a complaint against him is proven and he is disbarred, even if he managed to pay off the complainant and make him withdraw the complaint he cannot expect to be reinstated.

    What is wrong with these people? The leader of the Pakatan is an ex convict who spent six years in jail for abuse of power. He ordered the Police to arrest and torture Ummi Hafilda Ali because she wrote a letter (complete with her name, IC No and Address) that Anwar Ibrahim was involved in a sexual affair. For this crime of abuse of power to save his own backside, Anwar Ibrahim was sent to jail for six years.

    Then he was also found guilty of sodomy and sent to jail for 9 years. Altho his jail sentence was overturned TEN JUDGES still found him guilty. Only TWO judges in the final sitting of a three man Federal Court found him not guilty on a technicality. They Court said they concur that sodomy did take place.

    The leader of the Pakatan Rakyat is an ex convict who went to jail for criminal abuse of power and sodomy.

    Anwar Ibrahim is also wealthy. His war chest still runs into hundreds of millions of Ringgit. Money which he stole when he was in power. Everyone knows that.


    The Chief Minister of Penang also is an ex convict who went to jail for telling lies. In his efforts to save the "maruah" of a Malay girl, he took to telling lies which landed him in jail too. The Malay girl eventually came out and said 'please dont try to save my maruah, you got the wrong girl'.


    Lim Guan Eng got carried away by a trap that was initially set by Anwar's man Sidek Baba for Rahim Tamby Chik. When Guan Eng got carried away, the UMNO boys let him walk into the trap too.

    Now in Selangor Ronni Liu, Theresa Kok, Wong Chuan How, Ean Yong et all are embroiled in accusations of corruption and underworld connections by their own party members. The MB Tan Sri Khalid is also embroiled in corruption including using State funds to fix his own car.

    If the BN guys are dirty, do they become clean, born again when they join the Pakatan? Zaid Ibrahim is a multi millionaire who made millions as UMNO's lawyer. Is he clean now that he has joined Pakatan?


    Chua Jui Meng and his brothers are well know sharks in Johor. Does he become clean too just because he has joined Pakatan?

    Remember this : the Pakatan is led by an ex convict who went to jail for six years on a charge of abusing his power to bully and torture a young woman. The Pakatan is led by an ex convict, a criminal.

    I would suggest you read up the Legal profession Act before making a stupid comment that bar councul controlled by Indians and that's why they went for Rohaizat.

    The Bar Council is set up by Federal Legislation and EVERY lawyer must obtain a practisingcert from it. It is not by membership.

    It has legislated powers to disbar a lawyer from practising for "offences" against clients, etc. There have been many Indian lawyers who were disvarred too.

    So keep your mouth shut and be thought of by others as a fool instead of opening your mouth and confirming it to the world.

    The undisputed facts are these:

    1) a complaint was lodged against Rohaizat's firm well before Mar 2008
    2) due process would have given him the chance to response
    3) the Disciplinary Board found him guilty on 7 Mar 2008
    4) he returns the money and settle AFTER he was struck off as lawyer
    5) His appeal to the High Court was rejected (you cant right a wrong simply by returning the money)
    6) he is no longer a lawyer because of his actions and inactions

    ALL these took place WELL before he became a candidate. So where is the conspiracy?

    It is UMNO's screening process that is left wanting. I am disappointed with UMNO's moral and ethical standards.

    Is he really "the best" UMNO can offer to the electorate? Sad!!

    When in the company of crooks, the lesser crook is seen as saint!

  106. Bro, another detailed clarification from UMNO Legal Advisor Hafarizam's blog which makes sense above the maddening Pakatan Rakus crowd noise, excerpt from his posting :

    "Tindakan tatatertib yang diambil terhadap beliau(Rohaizat) adalah atas kapasiti bersesama dan berasingan [“joint and several liability”] di dalam undang-undang lazim perkongsian selaras dengan Akta Perkongsian 1961. Malahan, rakan-rakan kongsi di dalam firma guaman akan terdedah kepada liabiliti yang tidak terhad termasuklah perilaku jenayah, kecuaian dan pengabaian rakan-rakan kongsi di dalam firma guaman. Ini bukanlah suatu pembahagian liabiliti yang adil tetapi itulah bagaimana firma guaman diwujudkan di Malaysia tatkala ini.

    Justeru itu, adalah tidak tepat jika dikatakan bahawa Saudara Rohaizat bin Othman diadukan atas kapasiti perseorangan beliau sebagai seorang pengamal undang-undang walhal beliau adalah rakan kongsi di firma tersebut dan liabiliti beliau adalah terpaut kepada firma guaman beliau juga. Adalah diakui setakatmana bahawa tindakan yang diambil terhadap beliau adalah dibawah Seksyen 103D Akta Profesyen Undang-Undang 1976 tetapi itu samalah seperti tindakan diambil terhadap pengarah Syarikat yang diperbadankan."

    I smell something very-very fishy with the Bar Council Press Statement and its perfect timing and not telling the public everything that we should know. I wonder if the Bar Committee is apolitical or otherwise. I hope the Bar Council can be super efficient in clarifying Hafarizam's statement about their "inaccuracy" in their press statement.

    This time I agree with some of the readers...WHY BN DON'T DO THEIR HOMEWORK? To avoid confusion or -ve perspective they should put a caliber candidate ( clean, good track records and so on) why must put this guy Rohaizat even if he is already clear from any misconducts?

    Maybe..

    1) BN knows they will not win so put Rohaizat and they will have a good reasons if BN lost.

    2) Rohaizat is a scapegoat. (difficult to lower the majority of 5k)

    3) Strategic reasons

    4) Lobbying from some groups in UMNO and finally they make a wrong decision to put Rohaizat.

    That is my theory...

    This is the first time Pas and Umno seem to have mutual understanding in the sense that both seem to agree to put candidates are not free from any wrong doing and hence lay themselves open to criticism. The question is why?

    Yes, regardless of who might come out victorious in the contest, neither one of them would be given any special post by Dapiss who strictly controls the corridor of power according to their whim and fancy!

    That seems to be common in Indian lawyers. After 10+ years tenancy, my Indian lawyer landlady refused to return my deposit without even bothering to justify her action, and used her lawyer status to intimidate me from taking legal steps. Of course the money was less..
